Default Florida lake county eviction

Hi,

I'm a new landlord of a FL property, but live in another state. I'm preparing the eviction of my tenant (did not pay rent). After reading all the procedures and steps, still got this following question:

In Lake County FL's eviction process, can/should the "Motion for Default" and "Motion for Final Judgment for Possession" forms be submitted at the same time?

The reason I'm asking is that on the "Motion for Final Judgment for Possession" form there is a field that I need to fill for "date the Default was entered", which is a piece of info only available on the form of "Motion for Default" and can only be entered by clerk. Now if I personally go to the clerk's office to file these, I might be able to know the "Date" she/he put on the form, and then can fill that info to this field. So the 2 forms can be submitted on the same day. But what if I have to mail the forms to the clerk and can't personally go there?

Thanks a lot.

John

Why not cal the clerk of court for that area? He/She may be able to allow you to fax these forms into their office and give you the date for the line at the same time. He/She could also tell you if these forms can be filed at the same time or seperately. If you look up the county or city website for the rental area, there is usually a link to the clerk's office and frequently they have answers and samples of these forms online.

The clerk can also tell you if you need to appear in person for any filings or hearings or if you will have to obtain an attorney to do that for you. You may have to use an attorney for this eviction since you live out of state. If so, cal around and see if you can find one who specializes in ONLY evictions ands who does them for a flat rate fee.

Thank you for your suggestion. I'll call the clerk office first.
