Default Tenant/Lanlord Dispute

My landlord has bounced my rent check by cashing it before the agreed date. He has cost me $700.00 in fees and is refusing to reimburse me. Can I take the money that is owed to me and deduct it off my rent?

Please explain how someone owes you money for your bad check? Was it forged?

It was a post dated check given to my landlord. He cashed it prior to the date on the check which the money was not in my bank account at the time. By doing so he bounced all my transactions that were posting on my account creating a mountain of fees that I had to pay the bank.

OK it was not forged.

So you are claiming something illegal transpired and you suffered, right?

I don't know exactly what you are talking about that is illegal. On my end or his? However, I have suffered over losing half of my monthly income to pay back the bank. I am in a real issue over this. I just need to know what I can do to satisfy this problem on both ends.

Let me clarify,

Your check is a legal document, you assigned the pay to the order of, to the legal recipeint, you fill in the amount to be legally paid to that recipeint, then you legally execute this document with your signature, two things happen you attest that the recipeint has a right to the funds, and you promise that all the affirmations are true.

But you lie about the date the document was tendered and that all information on the document is true.

Please point out where I am wrong.

I gave my landlord a post dated check at the beginning of the month because I was going on vacation and wouldn't be able to give it to him when the rent was due. So I made sure he had the check before I left so he would get paid on time. My rent is not due until the 25th of every month. I have rented this house for 3 years without one problem. He cashed my check before my rent date per the lease agreement. He states that it's not his problem and refuses to reimburse me my fees. I don't understand why he would even do this. But he has cost me alot of money. I don't think it is fair and I want my money back. Do I have a right to take what is owed to me off my rent that is going to be due?

No, and I will explain why.

You are the only one that cannot cash your post dated check. To prove it go to the bank and make out a check for cash and date it 10 days in the future.

Well Thank you so much for calling me stupid. It really solves me and my son's living situation. I really hope you had a blast making fun of the unfortunate who try to do right. Live and Learn. I guess I will take what is mine and he can sue me for what he feels is his.
