I have been fighting stomach cancer since December 07. Sadly, it has not been very successful. I recently found out that it has spread and I was given 6-9 months. I am trying to process all of this, get my affairs in order. It's just been an incredible emotional strain as you can imagine. I want to die at home, my childhood home, where my parents still are. I have 9 months left on my lease, have been a tenant in this building for three years, always paid rent on time, and was never a problem to other tenants (always quiet, considerate, etc.). Do you think if i tell my landlord my situation, bring medical documents, they will let me go? I've lost my job and am collecting disability but it is barely covering my rent as it is. I don't want to neglect my legal obligation, but at the same time...i just keep thinking...i'm worried about this...this "real world" stuff when i know i'm going to be leaving it too soon. i just want to go home...that's all. do you think my landlords will be understanding and compassionate? they are a realty company but they're small and family owned. thank you all for your help and advice.

It is certainly worth trying. You would only be liable until they re-rent anyway.
And it seems it may be tough to collect from you or to sue your estate for any past due lease payments. Best wishes with all of this! |

I'm not sure if it would be a legal reason to break a lease. But what LL could argue with this reasoning? I'd let you out and tell you God Bless. Bring this up with yout LL. It is a heart-breaking situation for you. I hope they don't make it worse.

Thank you. I'm hoping they have a heart. What little money I have with insurance and social security, I just want to go to my son. There's still a slight chance they can operate, but it's very slight. I'm just so overwhelmed right now, and the last thing I want to worry about is my landlord suing my estate or surviving family members to get back rent. i know I would be liable until they re-rent, but I'm hoping they let that go too, because the money just isn't going to be there. I'm just going to go into their office Monday morning with my medical documentation and hope they are understanding. Thanks all for your kind thoughts. Bless you all.

Hello,
I just wanted to let you know that my LL released me from ALL obligations with my lease! They were all just concerned about me and my struggle, and they all said they'd pray for a miracle. They did put it in writing, too, and we shed a lot of tears and they asked if there was anything they could do for me for this month (I'm moving out the end of August) to not hesitate to let them know. They were very kind and concerned. Just thought I'd update on my situation It's a tough situation I find myself in, but this is one thing that is making it a little bit easier, financially and emotionally, as well as not having to worry about my son losing any of my insurance or soc. sec. money to my LL.

Glad to hear it worked out concerning your lease break. There are good LLs out there. I hope you can make a miraculous recovery. Take care.
