I rented some furniture to a commerical business in Texas -- this was a straight rental agreement not a rent to own.
That business has abandon its rental property and left my furniture. The landlord will not allow me to collect the furniture and is demanding a payment for storage. I have no contract or lease with the landlord just the deadbeat tennant. Can he do that under Texas law? |

You need to show your rental contract to the LL. He cannot just release property to you, as he is required under state laws to store abandoned tenant belongings for a period in case they come to claim it. Normally this is for about one month. Hopefuly your rental contact describes the property explicitly enough to be able to identify it from similar looking items. If you can identify it, it should be released to you with no storage fees. You owe him none since you had no contract with him. (You and he are both victims of an abandoning tenant. He needs to pursue his tenant to recover monies owed to him.) If he refuses, you may have to sue him in small claims court to recover your furniture.
