Questions - Judgment Debtor, VA
I had a major dispute with my landlord a few years ago and abandoned the premises with three months remaining in my lease. (Admittedly, that was a terrible mistake on my part, but I was a hot-headed teenager at the time.)
I was sued in June 2004 and again in March 2005 for non-payment of rent. Each time, I was sued for $1050 (three months rent) plus court fees. My landlord won both cases. I never received a summons or notice for the second court appearance; I learned about it via my credit report when I recently applied for a loan. I have a few questions . . . 1.) Can a person be sued multiple time for the exact same thing? If so, how many times can my landlord sue me over this matter? If not, how can I dispute the second judgment? 2.) Is my landlord required to apply my security deposit towards the rent if there isn't any damage to the apartment? My roommates and I had individual-liability leases. At the end of the term, they each received their full security deposit along with letters stating the apartment was in "excellent condition." However, my security deposit wasn't returned or applied to my balance. I am going to pay the first judgment through the court. (I'm making a special trip to VA to do it in person.) I'm just need advice on what to expect about the second judgment, and any help or advice is appreciated. |

I don't understand why 2 judgments were filed if you only had 3 months left on your lease? Was the 2nd one a renewal of the first? Contact the court. Let them know you received no notice of the 2nd case and don't understand why 2 judgments were filed. (Maybe there was a procedural issue with the 1st one and it had to be re-done?) If the judgement was already filed, the court should have taken your deposit into account. Are you sure there were no damages? No unpaid utility bills?
