There must be the issue of him saying,"Why should I leave." The business you have with the tenant is business, the business you have with your husband is personal. It would be morally and ethically wrong to try and "evict" her before she moves in. It has nothing to do with her. Imagine being her and getting that horrible news when you're excited about your new move. Besides, you don't know what she's going through, she may need the new environment, you may need a new friend. Work it out, but leave her out of it.

I can't comment on the original post since it was removed. But generally, once a lease has been signed by both parties and money has changed hands, it is considered a legal contract. It cannot be cancelled unless there is a breach on the part of one party. Even then, the government has steps and procedures that must be followed to terminate a lease. If the steos are not followed correctly, the lease either will not be terminated by a court, or the wronged party may sue the other one to recover damages and any legal penalties available. You may not change the terms of a lease until it ends.

As the other poster said, renting property is a business. Do not allow personal feelings or problems to interfere with business. All parties to a contract must be treated fairly according to the terms of that contract.
