"Was the lease in your name or your husbands name? If just your husband, some states require that the person suing present an affidavit that the person being sued is not in the military."

It doesn't matter. The Servicemen's Act (formerly Soldiers & Sailors Act) allows military members and their families to terminate a lease upon transfers. So either one could terminate lawfully.
