a renter was evicted and refuses to leave.
he is going to visit the day after tomorrow. can i put his personal property in a shed in the backyard? the gate is locked. thank you. |

No. If he has been evicted by a court and refuses to leave, you must go back to the clerk of court. This is the last step of the eviction. Ask the clerk for the procedure to schedule a court set-out of the tenant. The sheriff or bailiff will come to the property and physically remove or supervise your removal (depending on your area laws) of the tenant's belongings to the curb. If he has not been ordered to leave by a court, you need to follow the court procedures for an eviction in your area.
You may not change the locks or lock out a tenant until the entire process is complete (including the court set-out). After that, you may change locks and keep the tenant from returning. Do not lock out the tenant unless you want him to sue you. Do not remove his beloingings. |
