I'm suing my realtor in Washngton state, who managed my house for being negligent and for his inaction, incompetent.
After the first tenant took off without paying rent I told him that I am not going to have the house rented again unless he properly screen and do a good background check on the tenant, he did a background check and the results show the tenant records obviously shows a history of indebtedness and a series of bankruptcy since 1998 and 2007, clearly an unqualified renter and cannot afford rent. He put the tenant to our house without collecting the full first month rent, did not collect any security deposit, failed to do a pre-moved in inspection and after the tenant told him, she's not going to pay rent ever, my realtor told me tht there is nothing he can do about it but wait, si I told him to do a pay or quit premises, he was reluctant, but when I insisted to have him do it he did notice. But after that the realtors lawyer sent me an email saying we can't evict tenants and I could be held liable. What? This caused me a lot of emotional stress and anguished. I have to looked for a lawyer in the internet since I lived now in Texas. The lawyer I hired sucessfully evicted the tenant in one hearing, but my house was trashed, carpet so dirty, house need repainting, cleaning etc. I will have to spend $5,000 to put t back to it's marketable condition. I lost 7 months of rental income ($11,200), spent $1,000 in attorney's fee plus waste of time. I was pying $1,600 monthly for the mortgage and utilities for the tenant I did not put in the house and would not pay nor go away. Also found out from the tenant he took $400 from her without telling us. Now, my lawyer said he can do a demand letter/ negotiation letter to the realtor and his broker, but I have to give him $1,000 to do that. My question is, Is there a website I can research on How To do this demand letter so I can do it myself.? I'm really broke now and want to do this myself for now. We have to do this before my lawyer do the ctual lawsuit. Thanks! |

Personally, I'd get another attorney. Charging $1000 to simply write a letter to the agent to demand he pay damages for his negligence in doing the job he was hired to do is simply outrageous. It should cost you no more than a couple hundred at best for a letter. Try calling other attorneys and ask what they would charge you for this. It will hold more weight coming from a law firm than from you. You could also just file a small claims suit against the agent for negligence and damages.
