And the Tenant wants to leave in just 21 days - are they liable for the full 90 days of rent... or only for 1 month or just the 21 days they were there?

I'm confused on this post. What do you mean "evicted" in 90 days? Did you give them notice to be out of the unit in 90 days so you could sell the property? (That's not an eviction - an eviction is a court action.) Did you give them a date to be out, or state that they had to be out within the 90 days? It makes a difference. If you told them to vacate on, say, August 31st, and they left June 21st (I know those aren't the right dates - it's only for example), they owe until the end of wither their notice period (the written notice they gave that they were moving) or until the end of their lease. If you told them to be out before August 31st, you may only be able to charge them with the 21 days they were there. They only followed your instructions and were out before that date.
After they were informed the property was to be sold, did they then give you 30 days notice (or whatever is proper for your area) that they were moving? What area or country do you live in so we can look up the law in that area? I really need more info please. Please re-post with more details. |
