VA-Showing rental prior to leaving
I gave a 60 day notice that I would not be renewing my lease and would be moving on or prior to August 1, 2008. The rental company is now demanding to inspect the condo and set it up to be shown to potential renters even though I work from home and will be living in the unit during this time. I have asked for guidelines, but have not received them. Can they put a lock box on the door and can agents come in whenever they want? Do I have any rights at all? I want to help, but feel 7 weeks of this is going above and beyond the call of duty...I am also not prepared, nor is the unit, for showing as I am packing & cleaning. Any information would be greatly appreciated!

Sorry, but it looks like you're going to have to put up with it. VA state law allows them to show the unit to prospective tenants as long as they give you 24 hours notice prior to a showing. Send a notice to management that state law requires this amount of notice and that you must have it since you work from home. As long as you are given this amount of notice, you have to allow showings. The only way to stop it is if they abuse the right of entry. (And I'm not sure a judge would think that showing a unit to applicants when you've already given notice is abusive.) Hopefully they will find a new tenant quickly and take a holding fee from them to stop further showings. Try to make the unit look its best now and you may not have to put up with later showings when everything is in boxes. (Was the 60 days notice a lease requirement? State law doesn't require 60 days in VA.)

Thank you for the response. I received the 60 day notice to either renew the lease or provide notice that I was not renewing the lease, so am assuming it is part of their lease agreement.
The 24 hour notice is good to know, it is a bit disconcerting having a lock box on the property! |

You can ask that no lock box be installed, but that they give you 24 hours notice to enter and you will let them in.
