I have been out of my previous residence that I rented for 14 months. I received a letter today from the sheriffs office stating "(me) fell behind on rent due to a car accident. I knew he was going to receive a settlement from the insurance company. He got the settlement and then moved." He is seeking 3200 dollars repayment for backed rent. First of all I have paid him all of the rent, unfortunately I paid him most of the rent in cash, per his request. Secondly I havent been there in over 14 months and just received my settlement 4 months ago. So the entire statement is false and an outright lie. But my question is how do I prove that I paid him his money when it was paid in cash and no receipt given. Also Im not 100% but I dont think there was even a lease, not that it matters since he was paid his monthly rent. This all took place in West Virginia. This guy is an exfriend so I didnt see a problem with it at the time. It appears hes fallen on hard times and is trying to scam me out of money. What can I do here? Any input would be greatly appreciated.

Do you have any proof at all of the rent being paid? Bank statements that show the exact amount of rent withdrawn each month? Witnesses? Any receipts that show there was no balance? Check (employment) stubs and deposit slips that show a difference (the amount of rent) each month that was not deposited in your bank? If not, it will be your word against his in court. Try to come up with any shred of evidence you can find to tip the scale in your favor. Dress appropriately for court. Be polite, Speak when spoken to. Show respect for the judge and the court. Do everything you can to impress the judge as an honest person. And politely question the discrepancies in the statement you recieved. Perhaps the judge may see this as a scam.
