Default Tenant Wants to Leave Early****Maryland

Hello,

My tenant wants to early terminate their lease agreement. They have seven (7) months remaining on the lease. As stated in the agreement, if the tenant wishes to early terminate the agreement, the tenant agrees to pay the landlord the remainder months on the term (which equals out to 7 months).

My tenants are a company that was doing work in MD. When we were in negotiation, they wanted a 6 month term, but because of the increase in rent, they agreed to a 12 month term for lesser rent. Now that their job is complete, they want to leave...Please advise!!!

They are liable for the rent until you can re-rent.

But you do need to make efforts to rent the place if they leave.

Perhaps they can find a new acceptable tenant for you.

Okay, that is the same thing I read in the Maryland Law but just wanted to be sure. Thanks a million.

Also, in saying that, I will start finding a new tenant (I also read that the tenant will be liable for that also) but what if I can't find them a new tenant paying the same amount, can I request that the tenant pay the remainder of what the new tenant is paying (if agreed between all parties)?

You are responsible to take prompt, reasonable steps to find a new tenant. The old tenant is responsible for rent until the unit is re-rented, advertising to find a new tenant, utilities if his lease said they were his responsibility (in some areas-check local laws), the difference in rent until the end of the lease if you must take a rent reduction to fill the unit, and any other unreimbursed expenses you suffer because of their lease break. He is also responsible for any damages beyond wear & tear done to the unit. These costs should all be itemized per deposit statement and subtracted from his deposit. This statement should be sent to him within 30 days of his leaving.

None of these deductions has to be agreed upon by the tenant. They are your right by law.
