I have purchased a condo in Kauai, HI. There was a long term tenant residing there. His contract is month to month. In the rental agreement it states that a 45 day notice to raise the rent must be given. It also states that if the condo is converted to a vacation rental, the tenant has 120 days to vacate. My question is can I give him notice that it is becoming a vacation rental and raise his rent in the 120 day period?

Why couldn't you give 2 separate notices? First, at mid-month give him the 45 day notice that the rent will be increased. Then at the beginning of the next month, give him the 120 day notice to vacate. That way both notices end at the end of a month.
