tenant harrasing landlord
I gave my tenant a 30 day notice for numerous lease violations. (they also fell asleep at 3:00 am with food cooking on the stove almost burning my house down) since giving her the notice she has been screaming, swearing, threatening to (in her words) pumble me, refusing to leave, telling me that I can't make her. She has been leaving candy wrappers on my stairs knowing that my son has a severe peanut allergy, and giving my 13 year old daughter the middle finger.
The other day she turned the stereo up really loud and had the childen jumping and banging so loud the entire house was shaking. I knocked on their door numerous times no answer, when I went back upstairs to my apt. her boyfriend called telling me to fu**cking deal with it. I had to call the police, they took care of it. The next morning my daughter looked out the window to make sure the woman was gone before leaving for her bus stop the woman saw her and put up her middle finger then pretended to leave driving around the block 5 times waiting for my daughter to leave the house. My husband decided to drive her scared that the woman was going to do something, when my daughter and husband were getting in the car she pulled into the driveway screaming, swearing and yelling then started accusing my husband of sexual harrasment saying that she is filing a lawsuit. She also claims she is filing a lawsuit for smoke inhalation. She is trying to bully us into letting her stay. She acts like she owns my home. I know that it could take months to evict her Massachusetts law gives the tenant all the rights. I have found previous landlords that had the same problems with this family. Is there anything that I can do to stop her from behaving this way? My children are scared. Can I get a restraining order. If so what good would it do? Everyday it is something new. |

Report all threats and any incident involving the children to the police. Make sure they file a report on it. (You may have to insist.) Ask for their advice on how to handle it. Ask them to contact the tenant and have a talk with her. You do not want to speak to the tenant yourself as you may be filing for eviction shortly. You may also want to have you attorney write a cease and desist leter to her. If the police think you should file a restraining order against the tenant, do so.

wow. I am apalled at such behavior! I would post a notice to vacate stating where she has breached her lease and give her 15 days to move out. To make it look more professional I would post one on her door as well as send it certified mail, return receipt requested. I would also definitely call the police anytime they threaten you! I wish you the best of luck in this situation. I hope to come on this forum and see a thread of yours saying all is well and they are long gone. GOD bless.
