tenant for 23+ years
My question is how I can continue to live in my apartment if the original lease signers will no longer live there.
State: california, rent controlled apartment. Original lease signed by Mother and brother, with 3 others listed as occupants (myself included). Original lease was never renewed, currently on month-to-month. We've lived there for 23+ years and I have been paying the rent for the last 5 years (aprox). Original Lease has no sublet clause. If landlord chooses to evict me, do I have any rights??? Any legal advise greatly appreciated. |

Sorry, but without any lease and without the original lease holders in the unit any longer, the rent controled unit is not guaranteed to you. It is only guaranteed to the original lease holders and only under a lease. You have no protection against being given a 60 day notice to vacate the unit. I'm surprised in a rent controled unit that the LL allowed this to continue this long. If he gives you notice, start looking for a place immediately. If you are not out within the 60 days, an eviction can be filed against you for holding over. Once filed, it wil be very difficult to find decent housing.
