Occupational rent not paid!

Hi, I live in South Africa. I bought a house and currently pay occupational rent to the owner. The problem is that the person that is buying my house is already living there and does not pay my occupational rent according to the contract. The person has been placed on terms, but is still not paying. What are my rights?

I assume you have a signed written contract for him to pay. You will need to contact your local court about what steps you need to take to enforce the contract. Each country (and even each state within the US) has different proceedures to enforce rental and sales contracts. You will probably need to send notice to the party that he is in violation of the contract by not paying the rent, then after a certain number of days you can proceed to file against this person in court for non-payment. But check with your local court or a local attorney to get the correct wording for the notice and the amount of time you must wait after the notice before filing in court. Good luck.
