Sue for Company Fraud and get out of contract?
Hi all, I am not sure if this is the right place to post, but my friend is kinda in a difficult situation so I am here to ask for advice.
My friend is working in Michigan. He graduated from college just not too long ago and was offered a job at a consultant company. He took the training which the company claims to be $8,000 worth and signed a paper saying he will pay that training fee but the company will reimburse it after he works for 1 year for the company. Then comes the tricky part. When he was recruited, he was told that they will place him after the training. But after his training is complete, the company asks him to make up a resume saying he has 6 years of experience and start taking client calls and lie to them. It was different from what he was told when he was recruited as an entry-level consultant.
He doesn't feel right about that and starts looking for other jobs. Now he got an offer from a company in CA who is willing to sponsor his H1 process. He wants to get out of the contract and not paying the $8,000. Is there anyway he can get out because the company asks him to make fake resume? Can he sue the company for that?
I would really hope someone can help with this, he is not an US citizen and is on OPT right now. He tells me that what the company says about the placing is different than what he heard during his recruitment. I am thinking about calling a lawyer for him but don't want get things too complicated. Any suggestions will be appreciated, thanks all.
