I work in the kitchen at a new Restaurant located in A truck stop(its busy), Today at work my manager on duty was giving me a hard time about ticket times while I was training people during a rush and Infront of customers(raised voice and cursing) I said to him I know the ticket times were off and a few things got messed up, but talk to me later I dont want to hear about it right now,(Which I was told to do, if he gets loud and hostile infront of customers again, to get him quiet and in the back office) And proceeded to throw my backups on the grill to get ready for the next rush. Later when the rush was over i had a coworker cover the grill so I could step off for a moment and re-group. My manager called me to the side and proceeded to POKE me in the chest saying if I ever talk to him or another member of management like that again I would be fired, I said like what? Telling you I dont wanna hear about it when your making a big deal again (he's been talked to for acting out of line about this before) About 11 minute ticket times Infront of customers, And he told me to leave, I asked for my big boss'es number so i could call him about it, He refused to give it to me so I got it from someone else. At this time he told me I need to clock out and leave or he would call the police, I said im going to call my boss before anything was done and proceeded to go use the phone. He came back snaching phone numbers out of my hand and telling me Im not aloud to use the managers phone. so I went to leave and he blocked me at the doorway and proceeded to down me about ticket times and the way I was acting saying I was out of line for talking to him like that he finnally moved and I clocked out and left. I talked with the big boss who told me not to worry about it, he's aware of the way this manager has been acting toward employee's and that he was on his way out the door. to just show up to work the next day Then I get a call from the State Police who made me go in and file a report 65 miles away, and 2 1/2 hours of my time. Am I wrong for wanting compensation for this. The manager in question is almost undoubtedly getting fired but that just isent making me any happier about the situation. I'm carrying alot of extra dutys at this job to begin with (managers duty's and training people on top of working 3-5 stations and answering 100's of questions people should know by now) for A meagerly wage (although slightly more then my coworkers) now management put there hands on me. and belittled me infront of my trainee's on top of trying to intimidate me with a "thuggish" attitude just would like some feedback from someone who knows better! thanks! I would also like to add, this place just opened up its on week 3

and the manager in question openly has a history of violence and unsavery deeds he's trying to work on

I wish to inform you that you can clam compensation if provisions of employment contract has been breached or for defamation there has been a false accusation on you y your manager in front of other employees. You can first give a notice demanding compensation and if it is not paid then you can file a lawsuit.

No one has a duty to compensate you for complying with the request of the state police.

The manager is leaving. You have a great load off your back. No, the owner is not required to compensate you for your time complying with a police investigation of the incident.

One thing you can do if you feel threatened by this guy is get a restraining order against him from coming anywhere near or contacting you. The poking you in the chest could be construed as assault and grounds for you to fear reprisal from him, especially since he has been fired over the incident. The owner most likely does not want him around the place again, either.

Either one or both of you can apply for restraining orders against this guy coming anywhere near your place of work or residence. That way, should he ever show up again, the police will be coming for him. With handcuffs.

Violence at the workplace often comes from employees who have been terminated. This guy sounds like a time bomb.

Thanks for the feedback guys, I went to work today everything was fine, But upper management was no where in sight. I was told from another manager they are in fear I will drop a lawsuit on them. (possibly contacting lawyers to see how bad there situation is?) and is that even possible? (I suppose I should know my rights about that) But they will be there tomorrow so I should have a better idea of whats going on then, As far as the manager he's working tonight so im hoping they are waiting to talk with him in person too, The fact that he was not fired on the spot though has me a little upset and disapointed with the upper management to not even address the issue today, I would think this is something they would make some time for.



Things that have happend so far

Poked in the chest about 10 times to the point I got a slight bruise where he was hitting me
on camera I might add

I was shoved pretty good toward the prep table

I was talked down too and belittled infront of my trainee's despite the fact that I know much much more then him about the way things are supposed to be. (Its proven from day to day activities, And I have felt like he seen me as a threat to his job from the beginning, (He seems to get frusturated when i excell) As he was hired before I was. I have much much more experience in a resturaunt environment.)

he told everyone at work I quit yesterday even though i said id be back at 7am today, and also tried to fire me and write me off the schedual. He was told he has no power over me to do that.

I had a police report drawn up agenst me where 8/10 employee's said they witnessed him shove me and start the situation (on top of there being a video of the entire thing, although no sound i dont think)

I had to drive 65 miles and spend my afternoon in a Police Station giving my statement, where I did not press charges at the moment ( I would like to know if I reserve the right to change my mind, I should have asked)

I live in pennsylvania to clearify any state/federal differences

Im also out 8 hours pay which I had lost by being kicked out of the building by him, Which nobody but the big bosses has the power to do that to me again. From the mouth of the big manager on the phone before the police were involved to my knowledge. But they haven't been notified nor my position changed.
