We have recently been randomly drug tested by our employer. We have no active drug screening policy other than the 1 in our employee handbook that lists very specific circumstances that we may be tested, but no where does it list that there will be surprise random drug tests. We were notified of the test 15 mins before having to take it. Did they break any laws by making everyone take the test without ever signing a policy that states they will be doing random drug testing?

Call your labor board office. They will stop that kind of thing quite often. It does depend slightly on the facts of why it was done.
