I am currently representing my Vice President who was attending an advance school in for the bureau of customs and border protection. He was not required to pass the course, but some of the officers that were hired before this course was a requirement were required to pass this course. (Currently pending arbitration)
During the course he had to submit to a fat test that was conducted by a female PT instructor (not a nurse or doctor just a supervisor) on both males and females in the same room. He felt offended to have to watch a female bear her buttock in front of him and he was ordered to take his shirt off so the female instructor PT instructor could check his chest and belly for his fat content. (complaint 1) One of the students that has been performing the job for more than a year failed the requirement to pass the mile an a half run. That individual asked my Vice President for help. To which he did. He called the class coordinator, left a message on his cell phone and said this. (This person has a weight issue due to an illness that was addressed through surgery but is still over 80 pound over weight, he used to weigh 400 pounds, and he now weighs 220. PS. good for him) Mr. X I am the Vice President of AFGE Local 2859, I have a problem with one of your PT instructors Mrs. Y. I feel that she groped me and several of my class mates I feel that she was rude and treated us with disrespect. Second I have an issue with the young man that failed the PT test. I understand that he has to take the PT test again in three days. If he fails that test I will be forced to file an EEO on his behalf and things are going to get dangerous around here. But before I do anything I would like to talk to you about this. I will call you in the morning. Goodnight. You could formally complain and ask for a hearing on the matter within the organization. Are you doing that now?

yes, but my vice president is considering a retaliation EEO. What do you think? I am also going to file a ULP.
What do you think about the agencies claim that my VP. Threatened Mr. X with some type of violence? Like I said, I don't think he was threating Mr. X with anything but a EEO compliant. |

all of those claims of threats etc. have to be proven or they are meaningless...there has to be some kind of backup or witnesses etc
