REFERENCE LAW NC
I completed my second interview with a prospective new employer. Everything was fine. He said we just had to do reference checks with former employer. Drug and background came back ok. They did a reference check with former employer and the supervisor lied and said I did not give a two week notice. In fact he told them that I threw my keys at him and walked out. This is not true and spoke to the secretary and the owner and they ay I did give a two week notice and didnt throw kays at supervisor. I did not get the job because of the bad reference from former employee. What recourse do I have with former employer or supervisor?

I wish to inform you that you have been defamed by the supervisor. In this projecting wrong image of you to your prospective new employer reveals that your reputation has been harmed. You are being defamed by the supervisor. You can file a suit for slander. Slander involves speaking of wrong information to other persons. In your case the supervisor has wrongly informed your prospective new employer in order to harm your reputation. Hence, you may file for damages under slander. In this, the burden to prove the statement of supervisor as false will be on you.

I agree--If someone publicly says or writes anything factually untrue and it damages you, you indeed can sue for slander, libel, defamation, interference with business relations etc. -- or at least threaten to do so and give a warning. |
