I am in need of help. My employer told me on friday 10-9-09 that my insurance at work had been canceled due to a bounced check(that they wrote). I later found out from one of my daughters doctors that the policy actually expired on Aug-31-09 a month and a half ago. They have been taking out premiums out of my check every week nonstop and I have no insurance. They are telling me that they are trying to reinstate the policy but one person is telling me that it could take a week and another person tells me that it could take 4 to 5 weeks. I do not know what to do. I now have 15 weeks of insurance premiums floating around out there and no insurance to show for it. I work for a little mom and pop cabinet shop so I do not know exactly how to approach this situation. Any advice would be appriciated.

You could consult your nearest Department of Labor office to briefly discuss the issue with them first...you may also want to ask the company to put what is happening in writing and explain to them that you may have attorneys review the situation...try speaking to a higher level of management about the issue; they may override the other managers. If none of these efforts resolves the issue, let us know.

I can't go over there head they are the owners. They give two different stories though. They told me today that they would hopefully get it reinstated by Monday but that is a "hopefully". I tried to call the attorney generals office here in Kansas they just told me to contact a private attorney. I just do not know what to do.

The labor dept should be able to help you. That is clearly a labor law violation, and frankly theft of your funds.

To just clarify the point. My employer is taking money out of my paycheck every week for insurance that I do not have. They keep telling me that they are working on it. Even if they have the best intentions to in fact reinstate the insurance, it is wrong to take the money with there being nothing to show for it right? I have a fealing that when I go into there office to confront them one more time I am going to lose my job. I am tired of them taking advantage of me just to cover themselves. So I have to know that I have a valid complaint or if I am just making a mountain out of a mole hill.
