If a former employer is contacted by a potential new employer to verify employment of a past employee can that former employer release or communicate the reason or details for the termination of that past emploee legally ?? If not, what right does that employee have to take action against their former employer and what actions can be taken ??

Yes and they can give opinions etc. but they cannot say anything untrue or defamatory so most employers just give dates of employment--to avoid problems.
