Default Pension help, company in bankruptcy

Mid-America Pension Rights Project, one of several pension-counseling projects around the country, backed by the Administration on Aging, that provide free help to people with pensions. The pension projects cover more than two dozen states, providing free legal service regardless of age or income as long as you live in their jurisdiction, worked in it or belong to a plan in it.

The Mid-America project's Web site is at the address: elderlawofmi.org/pension_rights_project/index.html, and the phone number is 866-735-7737. "If you're having trouble in general communicating with your pension plan, the pension project can definitely help with that."

No disclosure of penalty for later enrollment when I was hired. Joined plan 2 yrs after hire date, still no disclosure. Defined benefit plan, non ERISA, private. Must I be penalized in receiving benefits when there was no disclosure of such a penalty at hire date or when I enrolled in the plan?


Non-disclosure of penalty for later enrollment in pension plan when I was hired or even 2 yrs later when I enrolled in the plan: non-ERISA, private defined benefit plan. Do I have right to NOT be penalized?
