Hostile Work Environment
I was employed in a large not for profit hospital for 18 years. I had risen through the ranks as staff R.N. to Manager of a 38 bed Critical Care Unit. I was responsible for 140 full time employees. I had always received an excellent end of the year excel review (raise). On March 12, 2008, my service line administrator called me at my home and propositioned my. I denied his advances. On the following day he summoned me to his office and at the end of our conversation he apologized for his behavior. I did accept his apology & thought little of it. On April 18, 2008 he walked into my office at 8:00 am & ask that I call 5 other employees into the office. He then proceeded to let us know that an administrative change would be taking place & that I would not be a part of the change. When I spoke with him on April 21 alone he let me know that I could not apply for either position, since they were going to be splitting my dept. When I ask him what promtped this, I was told I was too emotionally attached to the dept. On April 22 I spoke with the president of our employment services & his reply was that I was done wrong but that there was nothing they could do so I should "suck" it up & take any position. On April 24 I left for a scheduled vacation. On May 4, I went to see my physician & he placed me off on FMLA. I was not released until Aug. 4. During this time, I filed an EEOC complaint & would not give the hospital a copy of my phone records. I am currently waiting to hear from EEOC that I have the right to sue before an attorney can get involved. The last letter that I received from HR told me that I could have applied for either position but I could not due to the fact that I was out on FMLA. I did not exceed the 98 days that the state of MS allows you before an employer can replace you. I would appreciate any thoughts and comments on this situation. Thank you.
