My wife went back to work after giving birth to our daughter 4 months ago. Within one week she was offered a manager's position for another location. My wife accepted. They told her that they have other prospects and that to give them a chance to make their decision. My wife waited another week and received no word on what was to happen. She confronted the owner and they told her that they didn't want to take time away from her new baby and that they hired someone else instead with more experience. They must've repeated at least 20x that they didn't want to take time away from her and our baby, which is basically telling me that she didn't get the position because of the baby. Doesn't this fall under the discrimination law? I find it obsurd that she was refused because of that.

Yes that is normally not permitted--You could consult your nearest Department of Labor office to briefly discuss the issue with them first...you may also want to ask the company to put what is happening in writing and explain to them that you may have attorneys review the situation...try speaking to a higher level of management about the issue; they may override the other managers. If none of these efforts resolves the issue, let us know.
