Unhappy H2B workers

Good day! I'm a H2B holder here in kansas city, MO. My employer is Giant Labor Solutions LLC. Before we came here we have agreement between the employer and I that i'll work here as foodserver and i can look my own place that is affordable for me. They approved and agree. But when I arrived in KCMO last April 29, 2008, they force me to stay to their apartment which is so expensive. We are 5 in the apartment paying 300 each/month. We only have 2 rooms so 1 person stay in the living room. My first day of work is last May 3 as bacquet server-on call and I worked there for 1 day only and after that there's no serving job offer to me. Last May 8, 2008 they force me to work to another hotel as housekeeping, i don't have working experience on that field but still they want me to work there. We are paid by the rooms we clean $3.50/hr but the hotel is not so busy during weekdays sometimes i just clean 6 rooms and that's it for the whole day.And I remember, there's a couple of times that we worked for more than 10 hours without paying the overtime. We came here in the US to save money for our families not to survive. The salary that we are earning is not enough to pay the monthly rental and to buy food. I decided not to work in the hotel as housekeeping anymore, right now I don't have work I'm just like a beggar in the street asking and begging my employer to give me a regular food serving work and regular hours.

I'm asking your good office to give me some advise regarding my situation. Thank you.

Default Re: H2B workers

AS LONG AS YOU ARE WORKING AND GETTING PAY CHECKS FROM THE LABOR CERTIFIED EMPLOYER WHO PETITIONED YOU, YOU COULD SEEK NEW EMPLOYEMNT WITH ANY OTHER LABOR CERTIFIED EMPLOYER WILLING TO FILE A NEW PETITION ASKING IMMIGRATION TO ALLOW YOU TO TRANSFER. ONCE THE PETITION IS FILED AND APPROVED YOU CAN LEAVE THE EMPLOYER NOT TREATING YOU FAIRLY. YOU DO HAVE THAT RIGHT. BUT YOU HAVE TO HAVE CURRENT PAY STUBS FROM THE PETITIONING EMPLOYER TO BE ELLIGIBLE TO TRANSFER, SO HANG ON TIL YOU GET A NEW EMPLOYER TO FILE THE PETITION. THERE ARE THOUSANDS OF LABOR CERTIFIED EMPLOYERS IN NEED OF H-2B STAFF.
