My company is going tobacco free effective June 1, 2008. They are stating that we are not allowed to smoke, even if we clock out and leave the property, during our 15 minute breaks. Their reasoning is that we are on company time and therefore not allowed to smoke during that time. However, Kentucky Labor Law states that employers are required to give employees at least a 10 minute rest period for every 4 hrs worked and that the time is to be compensated. My question is that since this is a Labor Law requirement, is it technically considered company time?

Call your state dept of labor to discuss as well but they normally cannot stop you from smoking on your break time.
