tipshare fraud?

Confused tipshare fraud?

Ive worked at a restraunt in Texas for several years where i was paying out 3% of my total sales in tipshare to all departments at the resraunt. From what I've been told, it turns out it is illegal for some department to have been recieving tip share and the the tipshare was recently reduced to 1%. So, all the money (which is the 2%) i paid out to the restruaunt, the restraunt was illegally using to pay its other staff "more". Am I wrong to think i should get a lawyer and try to get back the money that was taken from me and used to illegally pay other deparments more. Do I have a case? ive done some of the math and it seem it could add up to over $10,000 or more over the years.--C
