Confused Severance Pay

I was recently laid off from Canfor-Canadian Forest Products Ltd, Clear Lake Division with the option to terminate my employment and take an enhanced voluntary severance package.

The policy states:

"Clear lake employees will have the option of terminating their employment and taking an enhanced voluntary severance package of fifteen (15) days for each year of employment."

I was employeed from April 2006 until January 2008 (20 months).

They paid out my severance package as if I was only an employee from September 2007 until January 2008. Which left me short over $ 4,500

They are refusing to pay me for my full employment as they are trying to say that I was not to be considered while I was working there as a Student!!!! Because I had the option of taking a day off in order to write exams or study for exams.

No where in the policy does it state that different divisions of employees such as Students, on-call, or full time would be treated differently in regards to the severance policy!

WHAT DO I DO?!!!???

Based on what you say here, you could file suit against them (or at least threaten to do so) in small claims court or in regular court; filing in small claims court is easier and requires no attorney...you could try to collect all of the costs and damages that you suffered due to their behavior...

You could also report that to the Ministry of Labour offices and ask them to help direct you.
