Hello, I hope that someone is able to advise me on how to proceed. Earlier this year my fiance had his k-1 interveiw in Casablanca, Morocco. He was asked a few questions about my famly,, the interveiwer to our photo album and told him he would get a call in a few days. 3 days later he was asked to come back, at that time he was given bacl the album along with a sheet of paper which stated he was not eligablw for the visa and "OTHER" was checked as the reason. I was there with him in Morocco at that time and I tried talking to someone but I was told I needed to inqure by email so I did. I received a reply which stated our petition had been sent back for further review. A few days ago I received an email from USCIS stating that our petitiion had been received back from Morocco on july 12 and is under review I will include a copy in this post.....
Can some one tell me what this means and what should we do now. I have been told I should withdraw the petition and go back to morocco and marry there the file for the k-3 (CR-1) I also have been told to wait for the result of the reveiw then diced whether to appwal or withdraw..... My first instinct was to file for the K-3 in the first place but at the advice of ohthers went fo the K-1. My fiance 's brother and sister both went through this same process a couple of years ago and had no issues..... However they both married WHITE NON-MUSLIM americans. I am African -American and Muslim.. That is pretty much the only difference in our cases... Their spouses don't make anymore money than I do. Actually I think my income is higher and they live in rural towns where I live just 30 min outside Washington DC. My fiance and his siblings pretty much have the same back ground.... No criminal history and lived at the same addres since the day they were born...... Another difference is My fiance and I communicated online much long prior to my going to Morocco the first time compared to his siblings spouses...... My fiance and I were both devistated that he did not receive his visa we were hoping he would come home with me when I was there in may...... There was obviously some problem and you only get so many bites at the apple. If they deny again you may never get your spouse in. |
