K1 Fiancee VISAs and Financial Support
Hello,
I'm getting to know a Filipina, and everything seems to be working right (except parents right now), but when things get fully right... when I officially ask her to marry me, and submit the documentation for her Fiancee Visa, what does the U.S. Gov't want for financial support? I've read that they want your three previous tax returns... at present I'm finishing College in December 2009, and don't have enough for the (I believe) 125% of Federal Poverty on my three previous returns... If I worked for one year (through 2010) and made the required 125%, would the one tax return showing enough income, plus 2 tax returns showing deficient income be enough to get the VISA approved? I'm hoping to acquire a job that will allow me to make at least $19,000 per year, which would hit the required amount, but I just don't have that amount on any of my three previous returns currently. Please help me understand this, and help me to know if this can be done. As of right now, my Father is against co-sponsoring her VISA, and I'm unsure if I want to ask others. Thanks, AE |

If you don't have a record of income you will have to have another person help to sponsor the application --see various articles about this process on the main site here.

Will one good tax return be sufficient? The Restaurant I've worked for, I've worked for since 2003 off and on (I've left for schooling) but have always been hired back on. And I'm hoping to pursue becoming a manager if my head manager will allow. But would one sufficient tax return be enough, or do they want a consistent track record of three years?

I am going through the exact same thing, I too am a student and will be graduating in December 2009. If your fiance comes here and has someone co-sponsor her it means she cannot get on medicaid or tanf. Anything that has to do with the government supporting you. If she does, your co-sponsor will be sued by the government and have to pay back what she was given. But once she becomes a permenant resident your co-sponsor is off the hook. You NEED a co-sponsor that meets the requirements, i have done my researching and asked different lawyers. The US Embassy will not let her come without the proof that she will not be a public charge. And your co-sponsor can live in a different state if necessary, but they prefer someone whose family and close to you in distance and in relationship.

I need help! My fiance is an American citizen and I'm from Europe. We're planning on filing papers for my K1 visa. He has sufficient income, but also has a debt of $40,000 for child support.
Is there any way for me to get the visa, or is it hopeless? |
