Love, marriage and immigration law.
Hi. Bear with me, please. My situation may help answer other's questions.
I am American with residency outside the USA....by choice and work! I met the love of my life in Paris (she is resident there....) 2 years back. I "sponsored" her a B2 tourist visa to visit my family and home in the USA. She has been to the USA 3 times on non-immigrant visa as "touist". We became closer, my family fell for her too and we married last summer while she was in the USA on a B2. She returned to Paris where she works and wishes to live. (10 year French residency...Algerian passport) She is a Masters gradate and professional with no desire to immigrate to America. This past October she returned to the US Embassy in Paris to apply for another B2.....did not state she was married after some terrible advice not to. They looked at her previous visits...to the same "sponsor" and threw her out on her head stating that "she was engaged to her sponsor". (we were, in fact, MARRIED.) I had no knowledge of this action since she wanted to surprise me with a new B2 to join me and my American family for our first Christmas together. I was furious at her treatment from the US Embassy...typical of the French style and arrogance. (my apologies to the French....you know what I mean though.) She was devastated. Her feeling is that the Embassy would never want to consider another B2....WE BOTH HAVE NO INTENTION OF HER IMMIGRATING TO THE USA. My question: Can the US Embassy in Paris be punitive and prevent her from a B2 tourist visa to visit WITH ME to the USA since she withheld the fact that we were already married? We both knew she did not have to leave after marrying (in the US) but she returned home properly for work without care to stay longer. I also had to leave for India for my job. Do I have recourse above the most arrogant and abusive treatment by the French employees at the US Embassy in Paris? We are legally married....I live in India as an airline Captain. We have a lovely home in Paris. Can I ever expect my wife to visit my parents with me in the USA with no intention to immigrate there? This seems to be a simple case of ignorance. If she wanted to stay in the US she would never have left after we married last summer. Sorry for the length but I know this has happened to others. BTW...dealing with the US Embassy anywhere is painful. No wonder Americans have become so misunderstood. So much for the long past American way. Thanks and may God bless us all. Capt. Cunny |

You can lay it all out in a well-reasoned document and hope they change their mind,
Frankly it may help to have legal counsel assist with the next application. If that is approved you will be fine going forward. World Law's lawyers could also probably intervene and help resolve this if need be. You may email them on the home page. |
