Default immigration question

hi, my name is BreAnna, let me tell you a little about the situation.
My Fiance came over to the united states 4 years ago illegally from mexico. He worked at the same job the whole time. I met him 3 years ago and we currently have 2 children together. in May he was deported. he got pulled over for driving without a liscence. I have several questions.
1) would it be better to get married and then apply for a visa or to try for the fiance visa?
2) i know we will probably have to file a waiver since he has already been deported but what is the likely hood that the waiver will be accepted?
3) Do i have to prove that i am capable to support them before he comes over? are there any exceptions to this rule?
4) Can i do this all while im living in mexico or should i stay in the U.S. while the paper work is processing? ( i would rather stay there)

Go to usicis.gov and you will find good info.
It is hard to answer your question since the immigration law changes a lot.
