am 53 year old and from Puerto RIco and currently employed in the private sector. I believe I am being discriminated due to my race and age. I have pending issues addressed to the Human Resource Department regarding my issues with my manager, who is trying to put me on a Corrective Action Plan for mistakes made 6 to 8 months ago which were not addressed to me at the time of occurance and without due process,thus denying my merit increase. There has been no 2-way communication or feedback on this which means I have been selectively discriminated since I have been treated diffrently and less favorable than my co-workers whose mistakes seem to be more \'permisable\'. I have employed with this company for 15 months now. Please adise my options,if any..Thanks.

You could consult your nearest Department of Labor office to briefly discuss the issue with them first...you may also want to ask the company to put what is happening in writing and explain to them that you may have attorneys review the situation...try speaking to a higher level of management about the issue; they may override the other managers. If none of these efforts resolves the issue, let us know.

Thanks for your advice. I did have a meeting regarding this with the Human Resource Director and she was supportive of my concerns and said she will try to 'wrap' this up as soon as possilbe. I was advised by a friend of mine who was a former VP of Human resources to be very cautious about everything I say and not to mention the word discrimination yet. She also mentioned (tactfully) that Texas is a 'At Will ' state and they do not need a reason for firing someone but they do not do so because its 'bad business'..I did not get into this but told her that I understood they 'At will' states can do this as long as they do not violate my civil rights (discrimination). If this were not true, why do companies from 'At Will' states make layed off employees sign a 'do not sue' disclosure statement' if they want their serverance pay if they do not need a reason to let them go?
Anyway, I will keep you posted on the end result of this,thanks once again.. |
