Demoted due to illness
I have a blood disease and feel that my boss demoted me due to my illness. He wants me to sign a document stating that it was a company reorganization and this is not why i quit, i quit because of the way i was treated and things he said.

You could consult your nearest Department of Labor office to briefly discuss the issue with them first...he normally cannot fire or demote solely for illness/
WLD lawyers could intervene if need be. |

Hello!
I work for a large company in ARizona. I have chronic pancreatitis. I was hospilized in March and April. Now I am sick again but not sick enough to be in a hospital. Just pain, nausea etc. I have missed a few days of work. I also have had to go in late or leave early due to doctors appointments that I made my manager aware of prior to going. On Wednesday my manager pulled me into his office and told me that the Director and the Stratigic Account Executive feels that my illness is a determent to the account and that the business is suffering because of it. He asked me if I could guarantee that I would be 100% for the rest of the year. I told him I cannot guarantee that. Long story short, they took me to HR today and offered the follow options. 1) Stay in the current position and anytime there was an issue with my performance or attendence there would be disiplenary action take i.e. write ups and possible termination. 2) I get demoted. They take away 6% of my salary and give me 3 months to 'get better' and possibly return me to the full pay again at that time IF I were 100% and not missing time. I want to know if in Arizona they can truly penalize me for being sick. I did not ask them to do this for me. They would not let me take the 'offer' paperwork home. But, they want me to think about it over the weekend and make my decision Monday morning. Help please, Thank you, |

No they cannot! Take the same advice as was given to the other poster.

PLEASE.....read the Americans With Disabilities Act & consult an attorney. It's bad enough to get sick, further, to be discriminated against because of it is against the law. HOLD THEM ACCOUNTABLE.

I would also report that to your nearest Department of Labor office.
They should help direct you. |
