here are the facts- i have been at the same job for almost a year. it is a resturant. there are only 10 employees and that includes the owner and his wife. the owner is the acting manager. there is a cleaning chemical that he was using that irritated my asthma. i told him many times that it affected my asthma and was making me sick. he continued to use the chemical. i ended up in the hospital. OSHA was called on my behalf because there is no MSDS book in the resturant. OSHA came in and conducted a investigation. the chemicals are no longer in the resturant. i know my rights when it comes to the owner and he can not harass me or treat me differently due to the call to OSHA. however, i am now being harassed by my coworkers, to the point that i have changed my phone number. what can i do? i did not want to get my boss in trouble and i am at a loss what to do. i didnt want anyone to get into trouble however i dont like ending up in the hospital either.

I wish to inform you that if other co workers are harassing you then you may file a complaint with your owner. If your owner does not take action then you may file a complaint with EEOC however it may involve action against your organization. Alternatively you may ile a lawsuit against co workers and can obtain orders from court that they must not call you.

How did they harass by phone. What were they actually doing?
It has to be quite severe before you can hold them or the owner liable. A few complaints or some general grumbling will normally not suffice. |
