Sexual Harrassment/Being Laid off
About a month and a half ago, I reported a manager for sexual harrassment. I went through the channels that were in my employee handbook. The case was investigated by corporate and the manager in question was terminated. The head manager informed me that I did the right thing at the time. The next couple of days, I was being harrassed by several fellow servers for going to corporate instead of going to the head manager. I reported this to the head man and he said something along the lines that everyone is entitled to their opinion but if anyone said anything to me from that point on, to go get him from his office and he would confront them on the spot. He also informed me that the manager let go, really didn't mean anything by his comments and actions that if I would have went to him, it could have been handled in the restaraunt. HE said he had known him for years and he spoke to him the same way at time. Red Flag for me...they were friends all along. Last Monday a co-worker called to ask me to cover her shift, I told her I wouldn't be able to get there at her scheduled time but would get there as soon as I could. I went in an hour and a half later than her scheduled time. On the way there, the head man called to ask where I was and I told him I was on my way. He asked why I was late and I told him that I really wasn't late because I had told the other server that I couldn't be there at the time she was scheduled because I was at a hair appointment. He laughed and said to not bother coming in at all. I replied with the word OK. I hung up the phone. I was scheduled to work today at 4:00. ANother manager called at 2:50 and said that they no longer had a position for me at this company because the head manager did not like the way I spoke to him on the telephone on Monday. I have never been written up, reprimanded, spoke to or anything. I have never been told of any customer complaints, never had a short cash drawer. In other words, no reason to be let go except that he was looking for a reason to right his friend after I reported him for sexual harrassment. Should I contact an attorney, is this retaliation or discrimination? I feel it is a little of both. I was under the impression that when I reported the manager to the corporate office, that no other superior was to be told what was going on. In other words, isn't what I reported supposed to be kept confidential from other employees of the restaraunt..management included? I live in Virginia.
