I was fired from a job in Massachusetts on June 3, 2002. I filed a
discrimination complaint against my employer in July, 2002. In November, 2002 I applied for and received Social Security disability . The Social Security Administration determined that I became disable on June 3, 2002, the day I got fired. Does that prevent me from filing discrimination charges against my employer? I did not claim to be disabled right up to the time I got fired, and I am not seeking front or back pay. Please refer to King v. Thomas Memorial Hospital. This case is similar to mine, except it went by the West Virginia guidelines. |

Normally that would not be an absolute bar to a claim. And you may still sue. You may also want to discuss the details with your nearest Department of Labor office.
