Physical discrimination?
I took on a job that required me to clean a clubhouse for a mobile home park along with my regular office work. As the clubhouse isn't big or difficult I have had no problem with this. I have worked there for 1 1/2 years. During my time with the park I have found out I have a compressed disc and fused vertabrae. My doctor is simply amazed I can walk at all and I have been the subject of journal articles he is (or has) writing/written. I have always communicated with my manager exactly what was going on and kept her up to date on my progress. In fact it was my manager that brought my attention to the fact that I needed to see a doctor.
Now my job description changed to cleaning mobile homes the park had bought to remain within the park. (Lost original job description paper) My chiropractor is impressed with my progress with therapy (which in no way interfers with my job) and has stated that I must see him after every mobile home I clean as this does throw my spine out of whack and puts me back months in therapy. As I only work part-time, I e-mailed the park owner to see if he would pay me the chiroprators fee every time I cleaned a home as this caused me great pain. Condsidering it's only a part-time position with no health benefits it can and will get expensive for me. Of course he does not want the liability. Though the manager is well aware of my limitations she is constantly sending me out to clean homes and I am yelled at for not moving fast enough to suit her. I am to be re-evaluted for my position due to my disability. Do I have any rights in this matter? |
