County PINAL State Arizona Zip Code 85232 Legal categories: Wrongful Termination Summary: Believe my employee rights was volated Case description: Went out on medical leave to have an operation. My FML protects my job for 12weeks well I recover. During these 12wks I was also hospitalize for other medical conditions. I stayed in touch with my job to keep them posted on my condition. The day of the end of my 12wks FML I had to have surgery again. I informed Human Resources two weeks in advance of this surgery because I knew my FML was running out. Oneday before my surgery I received a call from Human Resources Dawn Tani stating when will I be back. I informed her about my surgery that will take place the next day and told her I will ask the doctor after surgery when I could return. The doctor said in two weeks if all goes well so I call Human Resources and told them of this. A couple of days later I received a letter in the mail stating (due to my ongoing medical condition and not being able to return to work at this time therefore we (Jabil Circuit) consider that you have voluntarily resigned your position at Jabil. I believed I was wrongful fired because I just had surgery and was still out on doctors orders. I told Human Resources Dawn Tani, I need my job and do plan to return as soon as I was release from my doctor orders. I also have a copy of the letter that Jabil Circuit sent we. I never voluntarily resigned because I needed my job and in their own words how could they say I voluntarily resign. I spoke to the Attorney General Office and was told they can't say I voluntarily resign due to my ongoing medical condition. Just want to know if I got a case and need a good employment lawyer. You could consult your nearest Department of Labor office to briefly discuss the issue with them first...you may also want to ask the company to put what is happening in writing and explain to them that you may have attorneys review the situation...try speaking to a higher level of management about the issue; they may override the other managers. If none of these efforts resolves the issue, let us know.

I have a letter from them in writing and I did talk to my Labor Department about this issue. They told me I could talk to a lawyer about this. I talked to the job but they stood by what they said so when I talked to the Attorney General Office they told me what they did was wrong.

You could file in small claims or other court for the funds.

What kind of dispute could I raise with this case? Every Department I talk to say talk to a lawyer. Was wondering what a lawyer think about this case.
