My wife has been a department store manager for more than a decade. About 4 years ago she was diagnosed w/depression and anxiety disorders. Twice she has been taken to the hospital for treatment straight from work. Since her diagnosis,she has been moved to three different stores and now demoted out of management (with substantial reduction in pay). She was forced to sign a document agreeing to a demotion or she would have been terminated for "poor performance." Several days later she was back in the hospital. Is this discrimination? How should we procede?

They cannot fire or demote for purely illness reasons...You could consult your nearest Department of Labor office to briefly discuss the issue with them first...you may also want to ask the company to put what is happening in writing and explain to them that you may have attorneys review the situation...
