Supervisor explaining that AIDS is out there?
A few weeks ago, my supervisor at the coffee shop I work at, had come up to me, and started a conversation that I really took offense to. She had come right out and stated, that I "have to be careful, because AIDS is out there," for my "kind of people". (Insinuating that I am in fact a homosexual.) She's also been accused of calling me a "flaming fag" behind my back, to other employees and customers. She has said things like: "Your kind of people have different things to look out for, than my kind of people." And she used very derogatory terms and offensive phrases.
I took this to my managers above her and I, and they said that she would never say something like that, and that I'm making it up for attention. I don't understand why they would say that to me, as I've only been working there for a few months and have gotten along with everyone. I took it to Human Resources, and they said they would look into it, and launch a full investigation. Two weeks later, I called back, to check up on the investigation, and the Manager of Human Resources, told me that they had lost my field claim, and that if I wanted to file another one, I would have to go through my supervisor, then through my manager, then through HR if I had a problem. (Basically starting at the bottom of the policy change.) I just quit yesterday, and I understand that I should just let it go...but my family and friens are urging me to take legal action, and a legal liason has advised me to take legal action as well. I'm not really sure what to do. |

EDIT: Might I add, that it is Washington State Law, that it is illegal to, Employment Wise, discriminate against someone who is perceived to have AIDS/HIV, or anyone who is Gay.

You could file a complaint. It may be hard to file a full blown suit as you quit before giving them another chance to resolve etc.
There are mistakes made and things do get lost so it would have been somewhat better to have a fully documented file of inactivity or wrongful conduct by the employer. You could run this situation by a few local lawyers... Last edited by able1; Apr 27th, 2008 at 07:14 PM. |
