We have a planning application going through from a local resident who has taken a photo of our house for use in his application - without seeking permission from us. This application is now available on the borough council website. On these plans it shows not only our house giving the exact location details. The property is named (obviously) on the plans and the local post code given. The applicants have now posted a copy of all of this onto their own private website and now have had the site printed in an article in the county paper. Can they use a photo of our house on their site without permission? And does that not lead us open to the possibility of identity theft as these details are very widely available?

They should not use it if it is for any gain on their behalf--or if non-public information is available--and you may ask them to take it down.
