We operate a web site designed to help retailers find and learn about manufacturers. Regarding internet traffic, we use Google Analytics to gather information regarding networks that access our site. (No personal information is involved.)
My question is this - Can we publish a list of companies that access our site to potential manufacturers in order clarify the types of companies that are using our site in their searches? We do not plan to include information such as where the user goes within our site (i.e. specific pages or searches), and we could include a comment indicating that access by the user does not imply endorsement of the site. Many manufacturers have indicated they would list their companies with us if they know retailers are using the site. We felt publishing this list would accomplish that, but want to make sure we are within our rights to do so. Some comments we have received (just opinions, not legal advice) have indicated the user has a right to privacy and we should not publish company names without the company's consent. Others feel this is similar to a known person entering a retail store - it is not uncommon to read in the paper that a known person (i.e. a celebrity) was spotted in a store or restaurant. Publishing that information is beneficial to the retail establishment in terms of credibility. Just as people like to know where celebrities go, manufacturers want to know how retailers source their products. Does this argument apply to companies accessing an internet site? |

You normally cannot use their name without permission to promote your site saying they use your site etc.
Most will not object if you do it but a few will. The fact they stopped by does not always mean they agree with or like what you are doing either. |

I think it is better to have "customer testimonials" rather than putting those site. But in some case, putting just their link will be beneficial to them so some will surely agree, better ask permission first.
