Default Website is governed by which country's law

I am looking to launch a website and looking into the legal issues and ToS.

The site will have user submitted content and the law in my current country of residence(Hong Kong) requires the burden of proof on the publisher in any defamation disputes.

The site will be run by a Hong Kong company and the hosted in the US. Would it be advisable or even legal to have the site governed by US jurisdiction?

Also, would it be probable that whatever I put on the ToS, I have no way to force which jurisdiction or venue a dispute will be governed by, dependent solely on the offended party.

You are normally not a publisher if others make the content and post it.

But you can host in the US and make your terms applicable under US law and that will indeed normally be binding on users and readers etc.
