Default ISP subpoena

Can I sue an ISP if they give my info due to a subpoena --but without my permission?

You can if you are not a party to the legal action yes...ie if you are just a witness.

And most cable laws and civil procedure rules/laws require you be noticed before they release data even if you are a party.
