Hi. I recently found out that someone (I do not know who it is) is using my name, information and pictures from my MySpace and LiveJournal to create a fake profile under my name. For all intents and purposes the guy trying to give the impression that it is me.
1. He uses my personal pictures from MySpace profiles. (Are they copyrighted?) 2. He uses my personal information from there too. 3. He gives out some VERY personal information that only a few people know (i.e. sexual orientation) 4. I don't know if this constitutes libel, but on the fake profile he mentions that I smoke weed. Most other information, such as my sexuality, while personal, is still true. The problem is that the website is foreign-based (A Russian website, to be specific). I contacted the administration, yet no action has been taken. However, I have good reason to believe that this person knows me. In all likelihood he lives in North America (I'm from Canada), otherwise he wouldn't have known about my MySpace. Is there a way to subpoena a foreign website to give the IP address of a person? And if there is a way to find the IP address of the person, and it turns out he is located in North America, will I be able to press charges? Or simply put, what should I do legally? Thank you |

You can work through the chain and subpoena every part of the Internet process and ISP's etc. until you find who it is. You would have to file suit somewhere. But the police may also help you since the actions you describe are a crime as well.
And/or try emailing world law's lawyers and see if they can track it down for you. |
