Default Safeguard

Hi,
can you tell me whether "safeguard" is the exception of MFN or not? can a country exempt any Member whose import is not causing any sort of harm?

Hello,

As I understand it, injury determinations in safeguard investigations are based on all imports. You don't look at individual country's imports separately. There are certain exceptions that may apply -- e.g. for developing countries and for countries that are parties to a regional trade agreement -- but the basic rule is that you look at all imports together.
